Workmen' s Compensation Fund

The Workmen’s Compensation Fund is a fund established to provide protection and care for employees who suffer injury, loss of limbs, disability, death, or disappearance due to work-related accidents, or to protect the employer’s property (Work-Related Accidents). It also covers illnesses or occupational diseases (Occupational & Work-Related Diseases). Employers are solely responsible for making contributions to the fund (Compulsory Insurance). These contributions are collected as a reserve to pay compensation, including medical expenses and wage compensation, in cases where the employee is unable to perform their duties for more than three consecutive days.

Benefits of the Workmen’s Compensation Fund

Medical Expenses in Case of Work-Related Injury

  • If an employee suffers an injury or illness due to work, the employer must cover actual and necessary medical expenses up to 50,000 THB for initial necessary medical expenses
  • If expenses exceed 50,000 THB, the employer must pay an additional amount not exceeding 100,000 THB
  • If the additional 300,000 THB is still insufficient, the employer must cover further necessary expenses, but the total for these two levels must not exceed 500,000 THB
  • If all of the above are still insufficient, the employer may pay actual and necessary expenses up to a total of 1,000,000 THB, subject to approval by the Medical Committee and endorsement by the relevant board

In the case of inpatient care, expenses for room, meals, nursing care, and general services will be reimbursed up to 1,300 THB per day.

*Exception: If the employee receives treatment at a government hospital from the start until completion, or if there is a reasonable cause preventing initial treatment at a government hospital but the employee later receives treatment at one, actual and necessary expenses can be fully reimbursed until the end of treatment.

Notes:

  1. Employees treated at hospitals contracted by the Workmen’s Compensation Fund are not required to pay any medical fees.
  2. If treatment is received elsewhere, the employee must pay first and then be reimbursed from the Fund within 90 days.
  3. The employer must submit the Workplace Accident Notification Form (Kor Thor 16) and Medical Referral Form (Kor Thor 44) within 15 days of becoming aware of the incident.

 

Monthly Compensation

If an employee suffers an injury or illness due to work that causes absence, loss of working ability, disability, death, or disappearance, they (or their heirs) are entitled to monthly compensation equal to 70% of their monthly wage, up to a maximum of 14,000 THB per month, depending on the case:

  • Doctor-ordered rest from the first day, up to 1 year
  • Loss of working capacity for up to 10 years
  • Permanent disability
  • Death or disappearance, with monthly compensation paid to the heirs

 

Rehabilitation Expenses

  • Physical therapy: Actual cost, up to 24,000 THB
  • Surgical and medical treatment: Up to 40,000 THB (If necessary, the total cost, including all above, must not exceed 180,000 THB)
  • Medical rehabilitation equipment/materials: Up to 160,000 THB
  • Occupational rehabilitation: Up to 24,000 THB

 

Funeral Expenses

  • As prescribed by the Ministry
  • The funeral manager is entitled to 50,000 THB

Medical Treatment Procedure

Treatment at a Contracted Hospital

The employer shall refer the injured or ill employee to the contracted hospital. No advance payment for medical expenses is required from the employee.

Treatment at a Non-Contracted Hospital (Private or Government)

The employer or employee must pay medical expenses in advance, then submit receipts and a medical certificate for reimbursement.

Filing Deadlines

The employer or authorized representative must submit Form Kor Thor 16 to the Social Security Office within 15 days of becoming aware of the incident. The employee may submit a claim for compensation within 180 days from the date of injury. If the illness occurs after termination of employment, a claim must be submitted within 2 years.

 

Required Documents for Compensation Claims from the Workmen’s Compensation Fund

  • Incident Notification Form (Kor Thor 16) for reporting injury, illness, or disappearance
  • Medical Referral Form (Copy of Kor Thor 44), if the employee was referred to a hospital
  • Medical Certificate, either Form Kor Thor 16/1 or one issued by the medical facility
  • Original medical receipts, in cases where payment was made in advance
  • Copy of the employee’s Thai National ID card
  • Work attendance record
  • In unclear accident cases (e.g., car accidents or off-site incidents), additional evidence is required, such as: Police daily report, Accident location map, Employment verification letter, etc.
  • In cases of death or disappearance, additional required documents include: Death certificate, Autopsy report, Official death registration

Frequently Asked Questions

From the first date of employment, regard less of the registration from the employer

  1. Injured due to work-related accidents
  2. Contracting an occupational disease caused by the nature of the work
  3. Disappearance during work, with reasonable grounds to believe that the employee has died as a result of a work-related incident

The employer is solely responsible for contributing to the Workmen’s Compensation Fund, with contributions collected annually (once a year).

The annual contribution base per employee is capped at 240,000 THB per year.

This amount is multiplied by the contribution rate for the employer’s type of business, which ranges from 0.2% to 1.0%. Each employer pays a different contribution rate depending on the risk level associated with their business type, as classified by the business category code
