Change of Employment Status

The Expression of Intent in Changing of the Employment Status to University Employee

Clause 19: Any Government Official who expresses the intention to change their employment status to that of a university employee from February 7, 2012 onwards, shall be subject to review by the administrative committee of the relevant department. The committee shall consider the reasons and necessity for accepting such an individual as a university employee.

  • Suppose it is determined that accepting the individual would be beneficial to the university and there is a suitable vacant position for a university employee available, the administrative committee shall organize an assessment of the individual’s knowledge and abilities by the relevant provisions of the current personnel administration regulations, applied mutatis mutandis.
  • If the individual passes the assessment, the head of the department shall enter into a 1-year probationary employment contract with the individual.
  • If accepting the individual is not beneficial to the university, if no suitable university employee position is available, or if the individual fails the assessment, the expression of intent under the first paragraph shall be deemed null and void.

 

Clause 20: The start date of the probationary employment contract shall be governed, mutatis mutandis, by the provisions of Clause 17.

 

Clause 21: After nine months from the start date of the probationary employment contract, the administrative committee of the department shall conduct a performance evaluation following the criteria specified in the personnel administration regulations in effect at the time.

  • If the evaluation result shows that the individual has passed, the process shall proceed following Clause 10.
  • If the individual does not pass the evaluation, they shall continue to perform their duties until the end of the probationary contract period.

 

Regarding the expression of intent under Clause 16, an individual expressing the intention to change their status to a university employee may select one of the following dates as the official appointment and contract start date. However, the written expression of intent must be submitted at least 90 days before the selected date. The selected date must also be no less than 90 days and no more than one year from the date of submission.

Explanatory Notes for Government Officials Expressing Intent to Change Employment Status to University Employee After the 4-Year Deadline (from February 7, 2012)

  1. The following are the available dates for appointment as a university employee. The selected date must be at least 90 days but not more than 1 year from the date of submission of the written intent:
    • (a) January 1
    • (b) April 1
    • (c) July 1
    • (d) October 1
  1. Please attach a certified true copy of your Civil Servant ID card with your signature.
  2. Individuals eligible for a pension must have at least 9 years and 6 months of government service (calculated up to the day before the appointment as a university employee).
  3. Individuals who choose to receive a gratuity (lump sum) will no longer be entitled to government healthcare benefits.
  4. The form must be submitted at least 90 days in advance of the intended appointment date, to allow time for the departmental administrative committee to assess the individual’s knowledge and abilities, and for the university to consider the reasons, necessity, and benefits of the appointment.
  5. Individuals expressing intent to change employment status must receive an evaluation result of “Good” or higher from the departmental administrative committee to be deemed as having passed the knowledge and ability assessment before submission to the Executive Committee.
  6. If the Executive Committee determines that the appointment is not in the best interest of the university, there is no suitable vacant university employee position, or the individual fails the assessment, the expression of intent shall be rendered null and void.
  7. If the Executive Committee approves the appointment of the individual as a university employee, the university will issue an official order and appoint the individual as a university employee on probation. A one-year probationary contract will be signed.
    • Upon successful completion of the probationary period, the individual shall be formally appointed as a university employee.
    • If the individual fails the probationary evaluation, the department must inform the individual of the result. The individual shall continue working until the completion of the probationary contract term.
